Publisher Ellora’s Cave Sues Book Blog Dear Author #ChillingEffect

I’m sure most of you have heard about this. For those who haven’t, a quick recap.

On September 14, Jane of Dear Author wrote a blog post titled The Curious Case of Ellora’s Cave. She outlined the history behind the company – praising them for being one of the first e-publishers to offer authors and readers erotica-type content – then related news of their slow decline in management and business practices. Per Jane’s article and the subsequent comments from EC authors, editors and cover artists: authors and sub-contractors haven’t been paid in a timely manner; royalty checks are at an all-time low and Tina Engler/Jaid Black, the founder and owner of the company has been taking shopping trips, buying new property and looking into starting new ventures (this, apparently, from her Facebook page, Twitter stream and personal blog).

EC is suing Jane and Dear Author for defamation, claiming what Jane wrote in her blog post was false.  I am not a lawyer. I don’t claim to understand a whole lot about the law in general and defamation in particular, but my basic understanding is that in order for EC to win this suit they have to prove that what Jane said – their authors/cover artists/vendors/editors/tax liens/etc not being paid – isn’t true. In order to do that, I would assume they’d have to provide company records, financial statements, etc. I may be mistaken about that, so don’t take my word for it, but I do know part of a defamation suit is proving what was said was untrue and that the untrue statements hurt the reputation of the one filing. So how else would they prove what she said wasn’t true but opening up their records for public scrutiny? Even worse, however, is that EC is demanding the anonymous commenters’ true names be revealed.

Here’s the thing, though. This suit isn’t about EC’s reputation.  Not really. It’s about is instilling fear in a community of authors and bloggers. Engler has been rumored to be notoriously vindictive when it comes to authors speaking out against her company. As bloggers, we’re often threatened by authors when we write bad reviews/report about the goings-on with the community, etc. That’s a scary thing for those of us who aren’t lawyers and don’t treat our sites as a business venture, but rather a hobby. I don’t know about you, but spending thousands on a legal battle isn’t my idea of a good time. Especially since this site doesn’t make any money on its own.

The Chilling Effect, defined by Wikipedia as:

In a legal context, a chilling effect is the inhibition or discouragement of the legitimate exercise of natural and legal rights by the threat of legal sanction.

Basically, I think EC filed this lawsuit as a scare tactic. They want bloggers and their authors/staff to be scared of speaking out against them. Sunita wrote a post about it that goes into more detail, but essentially EC  is saying “we’re watching you”. As Sunita says in her post:

EC picked the wrong person to sue, no question. But by filing at all, they’re also reminding their authors and editors that they have no compunction about publicizing the personal information of anyone they see as an adversary. It’s not necessary to sue an individual person in this case; suing Dear Author LLC would have taken care of their needs.* But it wouldn’t have sent the same “we know who you are” message. EC has already stipulated in internal communicationsthat authors “include both legal name and pen name when communicating with Ellora’s Cave.” This just ups the ante.

Author Courtney Milan wrote about not being cowed by EC and their tactics. In her post, On Limited Purpose Public Figures #notchilled, she discusses the effect this lawsuit has already had in terms of the Chilling Effect and says she is Not Chilled (#notchilled).

Jane has hired a lawyer and plans to fight this. I say good for her. Good for all of us. We shouldn’t be silenced. We shouldn’t be afraid that speaking out about a publisher or author will result in the worst possible outcome. We’re saying we won’t be silenced and we hope you won’t be either.

Rowena: This was just okay. I didn’t love it but I didn’t hate it. 

I don’t know what it was but the whole embarrassing themselves with the other witnessing it got to be too much for me. The first couple were cute and made me laugh but as they continued, I kept rolling my eyes because really? Was it necessary?

Holly:  I really liked the getting-to-know-you stage of the book. I thought they were both sweet and cute.

Where the story fell apart for me was once their secrets were revealed.

Rowena:  I’m with you with the secrets being revealed. I wasn’t a fan of The way Ashton handled her secret. I hated that she took the choice away from Nathan and then I felt like a bitch because of, well, her secret. I felt like because of what her secret was, I wasn’t allowed to think she was a bitch and that annoyed me.

Holly: You’re nicer than me. I didn’t feel bad for thinking she was a bitch. What she did was wrong. But I was also annoyed with him for letting her push him away. He should have fought harder.

Rowena:  I wasn’t a fan of that either. It was dumb that he was just waiting for her to wake up and smell the I want to be with him coffee. Especially since it was months and months before it finally happened.

I did like Ashton’s father and Fran from the store. Hell, I even liked Tressa and Britni. They were fun. But there was just something missing from the entire story because even though I read it and enjoyed parts of it, I never fully fell in with the story and I’m not sure why. I never fully connected with either Ashton or Nathan and when I finally closed the book, I was already moved on to the next book. There was no book hangover with this book.

Holly: Same here. I wasn’t impressed with either of them at the end. I actually read Brittni’s story first. I liked it a lot better than this one. I’m definitely interested in Tressa’s story, too. This one just fell flat. Meh.

Rowena: Who’s Brittni’s man? Did her book come before or after this one?

Holly: Brittni’s hero is someone she met in college. No Attachments is Book 1 and Brittani’s book, Misunderstandings, is Book 2.

I’m going to give it a 3 out of 5. I didn’t really dislike it so much as I just wasn’t excited about it.

Rowena: I’d give it a 2.75 out of 5.

Will it bring her deeper into Cole's heart, or will it be the end of Olivia's days in little Lucky Harbor?

 

Olivia has been living in Lucky Harbor for about a year and she loves it. She has a store and loves filling it with beautiful things. She was once a child star but after her show was cancelled, and she went a little nutty, she decided to change her name and make a new life for herself out of the limelight. She would prefer that no one know that she was once Sharlyn Peterson but unfortunately that doesn’t happen.

One morning she’s out walking when she sees someone fall in the water at the harbor. She immediately jumps in to save them even though she doesn’t swim all that well. The person ends up being boat captain, Cole Donovan, and he certainly doesn’t need saving. Cole ends up trying to save Olivia from hypothermia and the pair get a little cozy in the boat while trying to warm up. Olivia tries her bet stay away from Cole as she doesn’t need any complications in her life but she keeps running into him. Cole finds himself wanting to be near Olivia and makes a point of seeking her out.

Olivia has issues from her past. Her real family isn’t something to brag about but the people who she considered family, the people she worked with on the set, all abandoned her once her show ended. She felt betrayed and knows that even if she gets something going with Cole he’ll walk away. Despite those thoughts Olivia finds herself falling for Cole in a big way. The problem is that he’s an incredibly honest guy and Olivia’s been lying to him about who she is from the start. When he finds out can he forgive her and move past it all?

Another great story from Jill Shalvis! I’ve said it before and I’ll say it again – Lucky Harbor is one of my favorite series! The individual characters as well as the couples they make are so realistic and readable that I can’t seem to get enough of them.

In this story I never really saw Olivia and Cole getting together. Olivia had too many issues with family and people leaving her that I thought she would never open her heart to Cole. Cole had some issues as well, with his fiancé falling in love with his best friend, etc. He had trust issues, to say the least. When Olivia wasn’t coming out with the whole truth and nothing but the truth I saw the relationship slowly crumbling. I knew that Cole was going to take issue with her lying and of course, he did. The way that Shalvis had him working through it all surprised and thrilled me. She took his self-discovery in a direction I never would have thought of, but really enjoyed. Olivia finally came to terms with her past as well and that was something I wasn’t sure she could fully do.

The couples in Lucky Harbor all seem to help each other grow and that’s something I love reading. On top of that Shalvis gave us wonderful humor in this story that had me smiling throughout.

Overall, a fine addition to the series. I can’t seem to get enough of LH and can’t wait for the next book.

Tracy’s review of Mistletoe on Main Street (Briar Creek #1) by Olivia Miles

Grace and Luke were great friends before they saw each other as more. They were just 14 years old or so when they started dating and continued on that path for the next 10 years. Luke had every intention of asking Grace to marry him but she kept stating how boring their town of Briar Creek was. It wasn’t exciting enough for her and she wanted the big city. Luke knew that Briar Creek was his home and he didn’t want to live anywhere else. He finally realized that in order for Grace to fulfill her dreams he was going to have to let her go. He wasn’t happy about it and frankly neither was Grace, so she ended up moving to New York City.

Grace returned 6 months after she left seeking out Luke, wanting to win him back but by that time he was with Helen who he was engaged to. It’s now 5 years later and Grace is back for the 3rd time. The first was when she returned to try and win Luke, the second was when her dad died and now she’s back for Christmas. Her sister Jane asked her to come as their mother is having such a hard time dealing with life and Christmas.

Grace plans to stay far away from Luke but that doesn’t happen. He’s doing his own mourning – for his wife Helen who died two years prior and he can’t seem to let her or his guilty feelings go. That doesn’t stop him from seeking Grace out and enjoying her company.

Grace has decisions to make. She is a well known author who didn’t get such great reviews on her last book. Her writing muse has completely escaped her, her relationship recently tanked in NY, she’s been living on a friends’ couch and now she finds out that the bookstore her father owned has been shut down since right after he died. Grace decides that she’s going to try to make the store work once again, and even expand but that involves Luke in a roundabout way. Grace decides that she not only wants the bookstore in her life and to permanently live in Briar Creek but she wants Luke back as well. The problem with that decision is that Luke isn’t necessarily on board with it. He can’t seem to get past Helen, her death and what moving forward with Grace will mean for his feelings for Helen.

The first novel in the Briar Creek series was a good one. I really liked the town a lot and loved the Christmas spirit that everyone had. The town seemed quaint, cute and made me want to visit there so I could see all of the wonderful Christmas decorations as well. 🙂

Grace and Luke had a long history. I think after being apart for 5 years they each knew they had changed from the people they were before but it took a bit of time to come to that conclusion. They still had feelings for each other that had never gone away but they were each so leery to move forward. There were trust issues as well as deciding on their level of commitment together.

For Grace moving forward meant that she needed to stay in Briar Creek and fight the fear that she was making the wrong decisions for her life. She felt guilt about being away from her family for so long and losing the last years of her father’s life by never returning from NY. I love how she finally decided to put her family first and stay in BC.

For Luke moving forward was a bit more complicated. He had loved Grace but she didn’t want the same things he did in life so he felt he needed to let her go. The fact that he loved her as much as he said he did and then was seeing someone else and engaged just 6 months later made me raise my eyebrows, that’s for sure. I mean, 6 months? I can see dating someone else but already engaged? I found that really strange. Several years into the relationship with Helen he started to doubt himself and planned to talk to her about it when he found her dead. He’d lived the last two years dealing with the guilt of not loving her enough and he had to get past that before he could be with Grace. I did think that the ending of the book, where he finally came to Grace with an open head and heart was done a bit too quickly. I wanted more groveling! He kind of made an ass of himself with her and I truly wanted him to work a little harder for her. Unfortunately that didn’t happen.

In this story we also got to see parts of Grace’s sisters’ lives as well. Jane is married with a 4 year old daughter, Sophie, who is freaking adorable. I loved the parts of the book with her in it. Jane has a husband who is having an affair and the story tells us of Jane and how she deals with it all – especially around Christmas. We also got just a bit from Grace’s other sister, Anna, who runs a coffee shop. She is belligerent toward Grace at first but warms up after a time. We get the hints that there’s something going on with Anna and Luke’s cousin, Mark, but that’s not confirmed in the book.

While parts of the book were pretty intense and some parts were sad there were also happy times that put a smile on my face. Miles has gotten me invested in Briar Creek and I’m looking forward to reading the next book about Anna.

This was a great read. Andie has been in love with Heath, her brother’s best friend, since she was 13. They grew up together and now she works for him, but he’s never noticed her as a woman. The night of the town Valentine’s Day Dance, she hopes to finally change that and dresses to knock his socks off. Except..he doesn’t notice. A little drunk and a lot frustrated, she fills out a questionnaire about her and her fiance – adding her name as the bride and Heath’s as the groom – for a Great Wedding Giveaway the town is hosting. She accidentally leaves it on the table, then forgets all about it. Until three months later when the Chamber of Commerce tracks them down to tell them they’re semi-finalists in the giveaway.

When Heath sees how humiliated Andie is, he offers to pretend to be her fiance until the winners of the giveaway are chosen. He doesn’t see much harm in it, especially if it will save Andie embarrassment in town. Until they share a kiss in public. Then he suddenly realizes Andie is a woman, not just his best friend’s little sister and his employee.

There were so many great things about this book. Andie is an electrician, for one. She’s also tall, reed thin and more cute than pretty. She can out-fish, out-hunt and out-spit most men. All-in-all, she’s pretty much the opposite of every romance heroine out there. I loved it. Her feelings for Heath came across as very real. A lot of times when one is carrying a torch for someone their feelings are shallow or they love the ideal of the person. Andie really knew Heath. Her love made sense.

Heath was a little dense when it came to Andie’s feelings, but I like how his eyes were slowly opened to her and how his feelings developed once he realized she was an actual woman. His attraction to her came on slowly – he was so used to seeing her in the role of friend/employee – but he didn’t deny it. He realized pretty quickly he wanted more than just a fling with Andie and did his best to show her how he felt.

Mayberry has always been great at pulling me into a story. I finished this one with a smile on my face and a happy heart.

I’m told Beau, Andie’s brother, and Lily, her best friend, will get a book early next year. I’m really looking forward to it.
